Update, Sept. 4, 2026: NHTSA’s public record for the Cybercab Audit Query now includes both the agency’s Sept. 4 announcement and the official AQ26002 opening resume. The resume supplies primary support for the estimated investigation population and Sept. 3 opening date, superseding the earlier Reuters-only provenance for the roughly 1,000 figure.123
NHTSA announced that it opened an Audit Query into Tesla’s Cybercab self-certification and describes the Audit Query itself as “the enforcement action.”1 The official AQ26002 opening resume lists Date Opened: 09/03/2026, Action: Open Audit Query (AQ), and Population: 1,000 (Estimated).3
The 1,000 figure is the regulator’s estimated investigation population. It is not an Austin service-fleet count, a Texas registration count, a ridership count or a count of vehicles NHTSA has found noncompliant.3
The reviewed NHTSA announcement and opening resume do not announce a noncompliance finding, defect finding, recall order, civil penalty, stop-service order, closure or final adverse determination.13 NHTSA’s “enforcement action” wording describes the investigative Audit Query; these records do not establish that Tesla violated federal law or that Cybercab is unsafe or defective.13
What NHTSA says it is examining
NHTSA says the Audit Query will evaluate the process and technical data Tesla relied on to self-certify Cybercab to applicable Federal Motor Vehicle Safety Standards.13 The agency says the inquiry will also examine the extent to which Tesla’s certification depended on determinations that some standard FMVSS requirements are inapplicable to the vehicle.13
The reviewed records do not identify the exact FMVSS provisions under examination.13 That keeps the current question narrower than a finding that Tesla failed a particular standard.
NHTSA also says existing federal safety standards remain in force while the agency continues work on AV-oriented rulemakings.1
What the opening resume adds
Beyond the estimated population and Sept. 3 opening date, the AQ26002 resume says Tesla notified NHTSA that it had certified the deployed Cybercabs as compliant with all applicable FMVSS and that it plans gradually to expand commercial deployment to additional vehicles and locations.3 That is NHTSA’s account of Tesla’s notification; the resume does not resolve whether the agency ultimately agrees with Tesla’s certification basis.3
The resume also says the deployed Cybercabs lack permanently attached conventional manual controls including a brake pedal, gas pedal, steering wheel and mirrors.3 That vehicle configuration is part of the record, but it is not itself a noncompliance finding.
Reuters reported that Tesla did not immediately respond to Reuters’ request for comment on the audit.2 That is Reuters’ outreach result; Autonomous News did not conduct the outreach described there.
Tesla’s current Cybercab FAQ separately says Cybercab rides are available in limited areas of Austin.4 That service statement does not establish the vehicle’s federal compliance status. We covered the limited-Austin Cybercab rollout separately.
The next material evidence would be an AQ26002 information request or manufacturer response, a change in the investigation’s scope or population, a Tesla public response, an agency finding, a recall, civil penalty, stop-service action or closure. Until then, the supportable posture is narrower: Cybercab’s self-certification is under an open federal Audit Query, and the outcome is not established.13
